Auto Accident
Tourist in Orlando Florida Assaulted by Rental Car Employee A lawsuit was filed against a rental car company in Orlando, Florida when one of it's agents assaulted the Plaintiff. The defense claimed that there was no insurance coverage due to the intentional tort exclusion in their insurance policy. This matter was successfully resolved in favor of the Plaintiff. Wrongful Death Auto in Naples, Florida
The decedents Estate filed suit against the defendant's after the defendant driver lost control of her vehicle. Mitchell Fox was able to resolve this matter in favor of the decedent's widow and her newborn. (see also our Auto Accident page).
Auto Accident lawsuit against the City of Port St. Lucie
A lawsuit was filed against the City of Port St. Lucie alleging that a tractor being operated by a County employee struck Mitchell Fox's client's vehicle because the driver of the tractor failed to keep a proper lookout; and the failure of the County employee to place traffic cones at the construction site and have a flagman at the scene. Mitchell Fox's client underwent a surgical procedure because of this incident and also incurred medical bills and lost wages. Liablity and causation were disputed, however Mitchell Fox was able to successfully resolve this matter in favor of his client at mediation. (see also our Auto Accident page).
Florida Highway Patrol Coverup Auto Accident
Mitchell Fox was hired by his client who was injured when she was involved in an automobile accident. The driver of the vehicle she was in was traveling at 65 mph when he rear-ended another vehicle on the shoulder of the roadway. While there were pictures taken of alcoholic beverages in the vehicle, and the driver of the vehicle was clearly intoxicated; The Florida Highway Patrol Trooper only cited the driver who caused this horrific crash with "driving on shoulder of roadway" because the Trooper knew the driver of the vehicle that caused the crash. This matter is currently in litigation. A lawsuit was filed by attorney Mitchell Fox within 48 hours of the attorney being retained by his client. (see also our Auto Accident page).

Trucking
An out of State trucking company has agreed to resolve a matter in litigation shortly after arbitration. The Plaintiff received serious injuries after being sideswiped by an 18-wheeler. A lawsuit was immediately field when it became apparent that the Plaintiff's injuries and the insurance companies initial response to this matter warranted a "means to an end". A truck driver has a heart attack and crosses the I-75 median in Naples, Florida, crashing into Plaintiff's vehicle, resulting in death and injuries to various Plaintiffs. The defense raised the affirmative defense of sudden emergency, and thus denying liability. After extensive litigation involving many experts, this matter was successfully resolved close to the policy limits of insurance. (see also our truck accident page).
Greyhound Trucking Accident
Mitchell Fox has been retained to represent a minor child injured on a Greyhound Bus. The minor child's mother was not allowed to bring her child's car seat on the bus; as a result the minor child was injured on the bus. (see also truck accident page).

Litigation was initiated against a motorist who cut off the Plaintiff resulting in severe injuries to the Plaintiff. A renowned motorcycle accident reconstructionist was flown in and conducted a site examination of the scene with Mitchell Fox and his client. Railroad Accidents
Train/Car Crash in Independence Louisiana The Plaintiff's were severely injured when their vehicle was hit by a Canadian National Train. Mitchell Fox immediately flew to New Orleans to meet the clients and their families from Mexico. Plaintiff's alleged that there were improper warnings for vehicles at the railroad crossing for vehicles intersecting with the railroad tracks and that there was no coordination between the crossing gates going down and the traffic light near the track causing vehicles to back up on the railroad track when a train approaches. Slip and Fall Injury
Skating Ring Injury
The Plaintiff fell on roller skates after colliding into the roller ring entrance door because of poor lighting and lack of visibility of the black swinging door into the roller ring. Liability was hotly contested, and through extensive litigation and the construction of an exemplar model of the roller ring door the case was eventually resolved. Broward County School Injury
A lawsuit was filed after the Plaintiff was injured on a makeshift football field playing tag football. Liability was hotly contested. Mitchell Fox utilized two key experts; a renowned playground safety expert and an expert in supervising students in class. Volusia County School Injury
A lawsuit was filed against a school and a teacher alleging that the teacher violated the school's policies regarding disciplining a student. Other allegations of the complaint alleged wrongful termination, and negligence of a newspaper in publishing this incident. (see also our slip and fall page.)
Polk County Technical School Electrocution
Mitchell Fox was hired by a student who was injured when he was electrocuted at a Technical school in Haines City, Florida. (see also our slip and fall page.)
Home Depot Fall results in Death of Mother
Upon being retained by the Estate of the Decedent, Mitchell Fox immediately went to the Home Depot in Naples Florida where the incident occurred to investigate the matter. A lawsuit was immediately filed against Home Depot based on faulty design of a exit ramp that extended into the parking lot. The decedent was walking in the parking lot and fell over the ramp hitting her head on the ground resulting in the swelling of her brain and her death in a day. Mitchell Fox went to The Home depot headquarters at Atlanta Georgia and met solely with the senior adjuster for Home Depot and was able to successfully resolve this case for the decedent's family. Starwood Resort Slip and Fall in Orlando, Florida
Mitchell Fox immediately filed suit against Starwood after being retained by the Plaintiff who received shoulder and knee surgery as a result of falling on a basketball court at the resort. There was sand on the court from an adjoining volleyball Court which was acknowledged by the resort to be an ongoing problem. Walton County Slip and Fall at Public Dock
A lawsuit was filed against Walton County alleging that nails protruded from a public dock causing severe injuries to the plaintiff. After an expert was hired, the case was successfully resolved in favor of the plaintiff. (See also our slip and fall injury page.)
Southwest Airlines Slip and Fall
Litigation against Southwest Airlines, the manufacturer of the walkway bridge between the airplane and the terminal and Orlando International airport alleged failure to warn of a change in level of the walkway-bridge, and defective design. This multiparty litigation focused on Southwest adding "watch your step" signs to FMC Technologies walkway-bridge after taking delivery of the walkway-bridge from FMC Technologies. Mitchell Fox produced photographs of the walkway bridge without any warning signs before they were delivered to Southwest Airlines. Mitchell Fox videotaped his client undergoing physical therapy in Long Island, New York. After extensive litigation and discovery, this matter was successfully resolved in favor of the Plaintiff. Lee County School District slip and fall A lawsuit was filed against the School District of Lee County alleging negligent supervision and a dangerous condition in a classroom. The student was instructed to move an object in shop class that was to heavy and unstable and should have been professionally moved; which resulted in serous injuries to the student. After litigation, this matter was successfully resolved in favor of the student. (See also our slip and fall injury page.)
20 Story Fall Down Garbage Chute results in Wrongful Death of father of two children. This wrongful death lawsuit alleged that the employer of the decedent knowingly exposed the Plaintiff to an unsafe work environment resulting in his death. The lawsuit further alleged that the owner of the condominium failed to make its premises safe. Mitchell Fox traveled extensively to Colombia South America to discuss the case with the decedent's family. Liability was hotly contested with extensive discovery and depositions of experts and witnesses. This matter was settled resulting in a favorable recovery to the decedent's estate. A lawsuit was filed against the homeowner for failure to leash and control his dog and for strict liability. This case was successfully resolved in favor of the Plaintiff. (see also our dog bite page).
Lakeland Pit Bull Dog Bite
Mitchell Fox filed a lawsuit within forty-eight hours after being retained by the parents of a child that was attacked by a pit bull. The pit bull owner's homeowners insurance has an EXCLUSION for bodily injury caused by any animal owned or kept by you. The lawsuit alleges strict liability of the pit bull's owner, and negligence of the homeowners to avoid the dog exclusion clause in the homeowner's insurance policy, thus allowing insurance coverage under the homeowner's policy. Nursing Home Negligence
North Florida Nursing Home resident chokes on improper diet with Death
The Estate of the decedent initiated litigation against a North Florida nursing home. Negligence was based on improper diet and lack of supervision which resulted in Mitchell Fox's client choking on her food and her death. Litigation was initiated utilizing the appropriate experts, resulting in the resolution of this matter. (see also our nursing home negligence page).
St. Petersburg Nursing Home Resident Neglect and Abuse by Staff
The Estate of the Decedent initiated litigation against a St. Petersburg Nursing Home due to his neglect and abuse by staff. After Plaintiff initiated an investigation into this matter, this case was successfully resolved bringing closure to the wife of the decedent. (see also our nursing home negligence page).
Broward County Nursing Home Resident Neglect by Staff
The Estate of the Decedent initiated litigation against a Broward County Nursing Home due to her neglect. This matter was successfully resolved bringing closure to the sons of the decedent. (see also our nursing home negligence page).
Orlando Nursing Home Resident Assaulted by another Resident Litigation was initiated immediately upon Mitchell Fox being retained for this matter. The nursing home claimed that the assailant was at the nursing home for only a matter of weeks and showed no prior behavior that would harm other residents. This matter was successfully resolved after it was shown that there was lack of supervision of the residents in the nursing home. (see also our nursing home negligence page).
Neglect and Bedsores to Lakeland Nursing Home Resident
A lawsuit was filed by The Estate of The Decedent due to neglect and bedsores the decedent received while at a Lakeland nursing Home. Causation of the Decedent's injuries was contested by the defense. This matter was resolved after litigation. (see also our nursing home negligence page).

Hospital Negligence
Hospital Negligence-Parkison's Patient Skin Burned
Mitchell Fox was hired by his client on a Friday, and filed suit three days later against The Palms of Pasadena Hospital in St. Peterburg Florida. Suit alleged that the Hospital was negligent in giving a patient whom they knew shaked uncontrollably from Parkinson's disease, a scalding cup of hot coffee. Mitchell Fox's client received extensive second degree burns to his body. This matter is currently in litiagtion.

Catastrophic Injury/Wrongful Death/ Product Liability
The Plaintiff's Estate through attorney Mitchell Fox bought a wrongful death action against the United States of America, the installer of a halo brace, and the manufacturer of the halo brace for the improper installation of the halo brace, lack of follow up diagnostic testing and manufacturing a defective break away torque driver that allowed the halo brace pins to breach the skull and enter the brain, causing the infection of the brain and death of the decedent. Tree Suit against the City of Jacksonville
The City of Jacksonville tendered it's policy limits after the Plaintiff was severely injured after a tree fell on her. Medical Malpractice in Washington County and several doctors and a Community Hospital
A confidential settlement was reached in a case alleging that the decedent was not timely attended to upon visiting the emergency room, resulting in her death. Litigation was extensive and resulted in a successful resolution for the decedent's Estate. (see also our medical malpractice page).
Laser hair removal causes burns and scarring to the Plaintiff
A lawsuit was filed against a medical office for medical malpractice after the Plaintiff was burned through a laser hair removal procedure. This matter was successfully concluded after the deposition of the Doctor and his assistant who did the procedure. (see also our medical malpractice page).

Medical Malpractice - Birth Trauma
Mitchell Fox is engaged on a birth trauma case wherein the fetal monitoring strips showed signs of fetal distress 48 hours prior to the onset of a sudden prolonged deceleration. It took 48 minutes to do a C-section from the onset of a sudden prolonged deceleration. This matter involves several Doctors and medical facilities. (see also our medical malpractice page).

Cruise Ship
Plaintiff was injured onboard a cruise ship when a metal door hit her in the head causing a head injury. Plaintiff alleged that a gust of wind caused the door to open and that it was not properly secured. This matter was successfully concluded in favor of the Plaintiff. Construction Injury
The Plaintiff, 18 years of age, worked for a daily labor company, and was sent to a marble/granite company to clean its' facilities. He was severely injured when a slab of granite fell on top of him while he was helping load it onto a truck. The Plaintiff was not within the scope of his initially assigned duties. Injury from playground equipment
It was alleged that a playground manufacturer defectively designed a tube in a playground that caused injury to the Plaintiff. This matter was successfully resolved after contested liability. (see also our product defect page).
Bridgestone/Firestone Defective Tires
With the proper testing this matter was successfully resolved after it was alleged that the Plaintiff's tires were defective. (see also our product defect page).
Ford Motor Company and Cooper Tire have agreed to resolve this case in litigation involving a Ford Aerostar with Cooper tires. The right rear tire experienced tread separation, causing the Aerostar to roll over on Alligator Alley. The Estate of the Plaintiff and other Plaintiff's argued the Ford Aerostar had stability defects and the Cooper tires had manufacturing and design defects. The Plaintiff's also alleged that Cooper tire had removed rubber from critical areas of the tire to reduce costs. Liability, causation and damages were contested by both Ford and Cooper Tire, resulting in extensive litigation and costs to prosecute this case. Mitchell Fox traveled with two security personnel to a remote part of Mexico to meet the decedent's family. Mitchell Fox regularly traveled to Mexico City to conduct depositions and meet with the families of the Plaintiff's. Mitchell Fox upon being retained by the injured families, immediately went to the scene of the rollover on Alligator Alley and photographed the scene to preserve it for follow up inspection by his experts. Hairdryer Overheats
Helen of Troy has agreed to resolve this case where one of it's hairdryers overheated, resulting in injuries to the Plaintiff. Although liability was an issue, Mitchell Fox was able to successfully resolve this case. The Plaintiff is now able to obtain scar revision surgery due to the settlement of her case. Legal Malpractice
Legal Malpractice against Florida Law Firm has successfully resolved. The plaintiff was involved in a head-on collision while being represented by a Florida law firm. Plaintiff alleged that the Law Firm failed to take adequate steps to preserve the plaintiff's vehicle and it was destroyed by the storage yard. Plaintiff's prior Counsel was aware of an air bag defect claim which left the Plaintiff blind in one eye. Due to the malpractice of not preserving the vehicle and its component parts, Plaintiff's air bag defect case against the car manufacturer is all but destroyed. The storage yard and plaintiff's insurance company are named defendants in ongoing litigation. (see also our Legal Malpractice page).

Equine (Horse) Law
Mitchell Fox has filed a lawsuit against a veterinarian for his failure to culture a corneal ulcer which resulted in the horse losing it's eye and the Plaintiff incurring a large amount of medical bills. This matter is in litigation.
